ROZHODNUTÍ KOMISE
ze dne 5. prosince 2006,
kterým se mění směrnice Rady 64/432/EHS, 90/539/EHS, 92/35/EHS, 92/119/EHS, 93/53/EHS, 95/70/ES, 2000/75/ES, 2001/89/ES, 2002/60/ES a rozhodnutí 2001/618/ES, pokud jde o seznamy národních referenčních laboratoří a státních ústavů

KOMISE EVROPSKÝCH SPOLEČENSTVÍ,
s ohledem na Smlouvu o založení Evropského společenství,
s ohledem na směrnici Rady 64/432/EHS ze dne 26. června 1964 o veterinárních otázkách obchodu se skotem a prasaty uvnitř Společenství (1), a zejména na článek 8, čl. 9 odst. 2, čl. 10 odst. 2 a druhý pododstavec čl. 16 odst. 1 uvedené směrnice,
s ohledem na směrnici Rady 90/539/EHS ze dne 15. října 1990 o veterinárních podmínkách pro obchod s drůbeží a násadovými vejci uvnitř Společenství a jejich dovoz ze třetích zemí (2), a zejména na článek 34 uvedené směrnice,
s ohledem na směrnici Rady 92/35/EHS ze dne 29. dubna 1992, kterou se stanoví pravidla a opatření pro tlumení moru koní (3), a zejména na článek 18 uvedené směrnice,
s ohledem na směrnici Rady 92/119/EHS ze dne 17. prosince 1992, kterou se zavádějí obecná opatření Společenství pro tlumení některých chorob zvířat a zvláštní opatření týkající se vezikulární choroby prasat (4), a zejména na čl. 24 odst. 2 uvedené směrnice,
s ohledem na směrnici Rady 93/53/EHS ze dne 24. června 1993, kterou se zavádějí minimální opatření Společenství ke zdolávání některých nákaz ryb (5), a zejména na druhý odstavec článku 18 uvedené směrnice,
s ohledem na směrnici Rady 95/70/ES ze dne 22. prosince 1995, kterou se stanoví minimální opatření Společenství pro zdolávání některých nákaz mlžů (6), a zejména na druhý odstavec článku 9 uvedené směrnice,
s ohledem na směrnici Rady 2000/75/ES ze dne 20. listopadu 2000, kterou se stanoví zvláštní ustanovení týkající se tlumení a eradikace katarální horečky ovcí (7), a zejména na druhý odstavec článku 19 uvedené směrnice,
s ohledem na směrnici Rady 2001/89/ES ze dne 23. října 2001 o opatřeních Společenství pro tlumení klasického moru prasat (8), a zejména na čl. 25 odst. 2 uvedené směrnice,
s ohledem na směrnici Rady 2002/60/ES ze dne 27. června 2002, kterou se stanoví zvláštní ustanovení pro tlumení afrického moru prasat a kterou se mění směrnice 92/119/ES, pokud jde o těšínskou chorobu prasat a africký mor prasat (9), a zejména na čl. 26 odst. 1 uvedené směrnice,
vzhledem k těmto důvodům:

Směrnice 64/432/EHS stanovuje seznam státních ústavů a národních referenčních laboratoří pověřených úřední kontrolou tuberkulinů a činidel, seznam národních referenčních laboratoří pro brucelózu skotu, a rovněž seznam státních ústavů pověřených kalibrací referenčního pracovního antigenu laboratoře podle úředního referenčního séra EHS (EI sérum) poskytnutého Statens Veterinaere Serum Laboratorium, Kodaň, pokud jde o enzootickou leukózu skotu.

Směrnice 90/539/EHS stanovuje, že každý členský stát určí národní referenční laboratoř příslušnou pro koordinaci diagnostických metod a jejich použití schválenými laboratořemi. Referenční laboratoře jsou vyjmenovány v této směrnici.

Směrnice 92/35/EHS stanovuje, že každý členský stát určí národní referenční laboratoř příslušnou pro koordinaci diagnostických metod a jejich použití schválenými laboratořemi. Referenční laboratoře jsou vyjmenovány v této směrnici.
|

|
Směrnice 92/119/EHS stanovuje, že každý členský stát určí národní laboratoř určenou pro každou z chorob uvedených v této směrnici. Seznam národních laboratoří pro vezikulární chorobu prasat je uveden v této směrnici.
|
|

|
Směrnice 93/53/EHS stanovuje, že každý členský stát určí národní referenční laboratoř určenou pro každou z chorob uvedených v této směrnici. Seznam národních referenčních laboratoří pro nákazy ryb je obsažen v této směrnici.
|

|
Směrnice 95/70/ES stanovuje, že každý členský stát určí národní referenční laboratoř na odběr vzorku a rozbor. Seznam národních referenčních laboratoří pro choroby mlžů je uveden v této směrnici.
|
|

|
Směrnice 2000/75/ES stanovuje, že každý členský stát určí národní referenční laboratoř, která bude odpovědná za laboratorní zkoušky. Tyto národní laboratoře jsou vyjmenovány v této směrnici.
|
|

|
Směrnice 2001/89/ES stanovuje, že členské státy zajistí, aby národní laboratoř byla příslušná za koordinaci norem a diagnostických metod. Tyto národní laboratoře jsou vyjmenovány v této směrnici.
|
|

|
Směrnice 2002/60/ES stanovuje, že členské státy zajistí, aby národní laboratoř byla příslušná za koordinaci norem a diagnostických metod. Tyto národní laboratoře jsou vyjmenovány v této směrnici.
|

|
Rozhodnutí Komise 2001/618/ES ze dne 23. července 2001 o stanovení dalších záruk týkajících se Aujeszkyho choroby při obchodu s prasaty uvnitř Společenství, o stanovení kritérií pro poskytování informací o této nákaze a o zrušení rozhodnutí 93/24/EHS a 93/244/EHS (10) stanovuje seznam institutů, které jsou příslušné pro kontrolu kvality metody ELISA v každém členském státě, a zejména pro výrobu a normalizaci vnitrostátních referenčních sér podle referenčních sér Společenství. Tento seznam je stanoven v uvedeném rozhodnutí.

Příslušné orgány téměř všech členských států podaly žádosti o aktualizaci údajů týkajících se národních referenčních laboratoří uvedených v několika směrnicích a rozhodnutí. Navíc je vhodné, aby národní referenční laboratoře a státní ústavy uvedené v těchto právních předpisech byly uvedeny podle abecedního pořadí kódu ISO pro každý členský stát.

Z jasnosti a důslednosti právních předpisů Společenství je vhodné tyto seznamy v uvedených směrnicích a rozhodnutí nahradit.
|

|
Směrnice 64/432/EHS, 90/539/EHS, 92/35/EHS, 92/119/EHS, 93/53/EHS, 95/70/ES, 2000/75/ES, 2001/89/ES, 2002/60/ES a rozhodnutí 2001/618/ES by proto měly být odpovídajícím způsobem pozměněny.

Opatření stanovená tímto rozhodnutím jsou v souladu se stanoviskem Stálého výboru pro potravinový řetězec a zdraví zvířat,

PŘIJALA TOTO ROZHODNUTÍ:
Článek 1
Směrnice 64/432/EHS, 90/539/EHS, 92/35/EHS, 92/119/EHS, 93/53/EHS, 95/70/ES, 2000/75/ES, 2001/89/ES, 2002/60/ES a rozhodnutí 2001/618/ES se mění v souladu s přílohou tohoto rozhodnutí.
Článek 2
Toto rozhodnutí se použije od třetího dne po zveřejnění v Úředním věstníku Evropské unie.
Článek 3
Toto rozhodnutí je určeno členským státům.
