Nařízení Rady (EHS) č. 1461/93

ze dne 8. června 1993

o přístupu k veřejným zakázkám pro uchazeče ze Spojených států amerických

RADA EVROPSKÝCH SPOLEČENSTVÍ,

s ohledem na Smlouvu o založení Evropského hospodářského společenství, a zejména na článek 113 této smlouvy,

s ohledem na návrh Komise,

vzhledem k tomu, že dne 25. května 1993 podepsaly Evropské hospodářské společenství a Spojené státy americké Dohodu formou memoranda o zadávání veřejných zakázek (dále jen "dohoda"), jejíž účelem je zavést rámec vyvážených práv a povinností k vzájemnému otevření částí svých trhů v oblasti veřejných zakázek, aby bylo dosaženo liberalizace a rozšíření obchodu;

vzhledem k tomu, že Společenství a Spojené státy se také dohodly pokračovat v jednáních, aby dosáhly vyvážené úplné dohody v oblasti veřejných zakázek, která by se vztahovala na co nejvíce orgánů ústřední správy, územní samosprávy a jiných orgánů veřejné moci, a ucelené dohody o zadávání veřejných zakázek v oblasti telekomunikací;

vzhledem k tomu, že Spojené státy, přes významný pokrok dosažený v liberalizaci veřejných zakázek, ukládají sankce podle hlavy VII Trade Act z roku 1988, které brání uchazečům ze Společenství ucházet se o veřejné zakázky federálních orgánů Spojených států; že se Společenství domnívá, že takovéto sankce jsou diskriminační a neoprávněné;

vzhledem k tomu, že je proto nezbytné, aby Komise přijala vhodnná opatření k podobnému omezení přístupu uchazečů ze Spojených států k některým zakázkám zadávaným určitými zadavateli; že tato opatření by neměla porušovat povinnosti Společenství a jeho členských států vyplývající z dohody a Smlouvy GATT o zadávání veřejných zakázek;

vzhledem k tomu, že musí být pamatováno na výjimečné případy, kdy by opatření omezující přístup k veřejným zakázkám Společenství pro uchazeče ze Spojených států neměla být použita z důvodů veřejného zájmu a veřejné bezpečnosti,

PŘIJALA TOTO NAŘÍZENÍ:

Článek 1

Aniž jsou dotčeny povinnosti Společenství a jeho členských států vůči třetím zemím, odmítnou zadavatelé uvedení v seznamu v příloze I nabídky dodavatelů, podnikatelů a poskytovatelů služeb usazených a vykonávajících činnost ve Spojených státech směřující k

a) zadání veřejné zakázky na dodávky ve smyslu směrnice Rady 77/62/EHS ze dne 21. prosince 1976 o koordinaci postupů při zadávání veřejných zakázek na dodávky [1], jejichž odhadovaná hodnota bez daně z přidané hodnoty je menší než prahová hodnota podle Smlouvy GATT o zadávání veřejných zakázek; v současnosti 125576 ECU;

b) zadání veřejné zakázky na služby ve smyslu směrnice Rady 92/50/EHS ze dne 18. června 1992 o koordinaci postupů při zadávání veřejných zakázek na služby [2], jejichž odhadovaná hodnota bez daně z přidané hodnoty je menší než 200000 ECU, a všechny zakázky na služby, které jsou uvedeny v příloze II;

c) zadání zakázky na stavební práce ve smyslu směrnice Rady 71/305/EHS ze dne 26. července 1971 o koordinaci postupů při zadávání veřejných zakázek na stavební práce [3], jejichž odhadovaná hodnota bez daně z přidané hodnoty je menší než 5000000 ECU.

Článek 2

Členský stát však může povolit svým zadavatelům uvedeným v článku 1 přijmout takové nabídky, pokud jsou v konkrétním případě toho názoru, že přijetí takových nabídek je nezbytné,

a) aby nedošlo k omezení hospodářské soutěže na jediného dodavatele, podnikatele nebo poskytovatele služeb,

b) aby byly zajištěny plynulé dodávky nebo poskytování služby,

c) aby bylo získáno zboží nebo služby se zvláštními znaky, které nejsou jinak k dispozici,

d) aby nedošlo k vynaložení nepřiměřených nákladů dotyčného zadavatele veřejných zakázek,

e) aby byla zajištěna bezpečnost tohoto členského státu.

Tyto případy sdělí dotyčný členský stát neprodleně Komisi. Komise může konzultovat Poradní výbor pro veřejné zakázky zřízený rozhodnutím 71/306/EHS [4].

Článek 3

Komise může předložit případy uvedené v článku 2 výboru zřízenému podle článku 113 Smlouvy, aby v rámci Společenství zajistila prostřednictvím vhodných opatření koordinované použití článku 2 tohoto nařízení.

Článek 4

Toto nařízení vstupuje v platnost prvním dnem po vyhlášení v Úředním věstníku Evropských společenství.

Toto nařízení je závazné v celém rozsahu a přímo použitelné ve všech členských státech.
