amending Regulation (EEC) No 1687/76 in respect of cereals

THE COMMISSION OF THE EUROPEAN

COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No 2727/75 of 29 October 1975 on the common organization of the market in cereals (1), as last amended by Regulation (EEC) No 1451/82 (2), and in particular Article 28 thereof,

Having regard to Council Regulation (EEC) No 1418/76 of 21 June 1976 on the common organization of the market in rice (3), as last amended by Regulation (EEC) No 1566/83 (4), and in particular Article 25 thereof,

Whereas Article 4 (4) (e) of Commission Regulation (EEC) No 1974/80 of 22 July 1980 laying down general implementing rules in respect of certain food-aid operations involving cereals and rice (5), as last amended by Regulation (EEC) No 3323/81 (6), provides that, where an invitation to tender relates to the supply of products drawn from intervention stocks, the tenderer must undertake to supply those products without substitution;

Whereas intervention products may be exported as food aid either processed or unprocessed; whereas steps should be taken to ensure that there is no substitution of goods for export or processing; whereas the Annex to Commission Regulation (EEC) No 1687/76 (7), as last amended by Regulation (EEC) No 3432/83 (8), setting out the endorsements to be entered on control copies when a special use and/or destination of products from intervention has been prescribed should be supplemented to cover cereals and rice sent as food aid;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Cereals,

HAS ADOPTED THIS REGULATION:

Article 1

The Annex to Regulation (EEC) No 1687/76 is hereby amended as follows:

1. In Part I, 'Products to be exported in the same state as that in which they were when removed from intervention', the following point 33 and the footnote relating to it are added:

'33. Commission Regulation (EEC) No 1974/80 of 22 July 1980 laying down general implementing rules in respect of certain food-aid operations involving cereals and rice (33).

2. In Part II, 'Products subject to a use and/or destination other than that mentioned under I', the following point and the footnote relating to it are added:

- Section 104:

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
