PROVÁDĚCÍ ROZHODNUTÍ KOMISE (EU) 2020/1670

ze dne 10. listopadu 2020,

kterým se mění příloha prováděcího rozhodnutí 2020/1606 o určitých dočasných ochranných opatřeních v souvislosti s vysoce patogenní influenzou ptáků podtypu H5N8 v Nizozemsku

EVROPSKÁ KOMISE,

s ohledem na Smlouvu o fungování Evropské unie,

s ohledem na směrnici Rady 89/662/EHS ze dne 11. prosince 1989 o veterinárních kontrolách v obchodu uvnitř Společenství s cílem dotvoření vnitřního trhu (1), a zejména na čl. 9 odst. 3 uvedené směrnice,

s ohledem na směrnici Rady 90/425/EHS ze dne 26. června 1990 o veterinárních kontrolách v obchodu s některými živými zvířaty a produkty uvnitř Unie s cílem dotvoření vnitřního trhu (2), a zejména na čl. 10 odst. 3 uvedené směrnice,

vzhledem k těmto důvodům:

Prováděcí rozhodnutí Komise (EU) 2020/1606 (3) bylo přijato v návaznosti na ohnisko vysoce patogenní influenzy ptáků (HPAI) podtypu H5N8 v jednom hospodářství s chovem drůbeže v Nizozemsku a vymezení ochranného pásma a pásma dozoru ze strany příslušného orgánu uvedeného členského státu v souladu se směrnicí Rady 2005/94/ES (4).

(2)	Prováděcí rozhodnutí (EU) 2020/1606 stanoví, že ochranná pásma a pásma dozoru, která Nizozemsko vymezí v souladu se směrnicí 2005/94/ES, mají zahrnovat přinejmenším oblasti uvedené jako ochranná pásma a pásma dozoru v příloze uvedeného prováděcího rozhodnutí.

Ode dne přijetí prováděcího rozhodnutí (EU) 2020/1606 oznámilo Nizozemsko Komisi další ohnisko HPAI podtypu H5N8 v hospodářství s chovem drůbeže v provincii Gelderland a přijalo nezbytná opatření požadovaná podle směrnice 2005/94/ES, včetně vymezení ochranných pásem a pásem dozoru kolem tohoto nového ohniska.

(4)	Komise uvedená opatření ve spolupráci s Nizozemskem prozkoumala a přesvědčila se, že hranice ochranného pásma a pásma dozoru, které vymezil příslušný orgán uvedeného členského státu, jsou v dostatečné vzdálenosti od jakéhokoli hospodářství, kde bylo ohnisko HPAI podtypu H5N8 potvrzeno.

Aby se předešlo jakémukoli zbytečnému narušení obchodu uvnitř Unie a kladení neopodstatněných překážek obchodu ze strany třetích zemí, je nutné na úrovni Unie a ve spolupráci s Nizozemskem urychleně popsat nová ochranná pásma a pásma dozoru vymezená v uvedeném členském státě v souladu se směrnicí 2005/94/ES. Ochranná pásma a pásma dozoru uvedená pro Nizozemsko v příloze prováděcího rozhodnutí (EU) 2020/1606 by proto měla být změněna.

Do doby, než se uskuteční příští zasedání Stálého výboru pro rostliny, zvířata, potraviny a krmiva, by proto měla být příloha prováděcího rozhodnutí (EU) 2020/1606 změněna, aby byla aktualizována regionalizace na úrovni Unie za účelem změny ochranných pásem a pásem dozoru vymezených Nizozemskem v souladu se směrnicí 2005/94/ES a doby trvání omezení, která mají být v těchto pásmech uplatňována.

(7)	Prováděcí rozhodnutí (EU) 2020/1606 by proto mělo být odpovídajícím způsobem změněno.

(8)	Vzhledem k naléhavosti epizootologické situace v Unii, pokud jde o šíření HPAI podtypu H5N8, je důležité, aby změny přílohy prováděcího rozhodnutí (EU) 2020/1606 prostřednictvím tohoto rozhodnutí nabyly účinku co nejdříve.

(9)	Toto rozhodnutí bude přezkoumáno na příštím zasedání Stálého výboru pro rostliny, zvířata, potraviny a krmiva,

PŘIJALA TOTO ROZHODNUTÍ:

Článek 1

Příloha prováděcího rozhodnutí (EU) 2020/1606 se nahrazuje zněním uvedeným v příloze tohoto rozhodnutí.

Článek 2

Toto rozhodnutí je určeno Nizozemskému království.
